9. RISK OF LOSS

All purchases of physical items from Baltacioglu are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

10. RETURNS, REFUNDS AND TITLE

Baltacioglu does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Baltacioglu does not take title to the refunded item.

11. DISPUTES

In the event that you violate these Conditions of Use and we do not take any action, we will still have the right to use our rights and remedies in any case where you violate these Conditions of Use.

12. APPLICABLE LAW

By using any this site, you agree that agree that the laws of Republic of Turkey will govern these Conditions of Use and any dispute of any sort that might arise between you and Baltacioglu.

13. SITE POLICIES, MODIFICATION, AND SEVERABILITY

15. NOTICE AND PROCEDURE FOR MAKING CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT

If you believe that your intellectual property rights have been infringed, please submit your complaint by contacting us. We respond quickly to the concerns of rights owners about any alleged infringement, and we terminate repeat infringers in appropriate circumstances.

Conditions of Sale

These Conditions of Sale govern the sale of products on shop.baltacioglu.com.tr by Baltacioglu Muhendislik Makine Ticaret ve Sanayi Limited Sirketi (Baltacioglu) to you.

Please read these conditions carefully before placing an order for products sold by Baltacioglu, by placing an order you agree to be bound by these conditions.

1. OUR CONTRACT

With respect to products sold by Baltacioglu, your order is an offer to us for you to buy the product(s) in your order. When you place an order to purchase the product(s) from us, we will send you a message confirming receipt of your order and containing the details of your order (the "Order Confirmation"). The Order Confirmation is acknowledgement that we have received your order, and does not confirm our acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product(s) to you and send e-mail or post a message on the Message Centre of the website confirming that we've dispatched the product to you (the "Dispatch Confirmation"). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation for each package, and each Shipment Confirmation and corresponding dispatch will conclude a separate contract of sale between us for the product(s) specified in that Dispatch Confirmation.

You consent to receive sales invoices electronically or printed. Electronic invoices will be made available in pdf format in the Your Account area of the web site. For each delivery, we will inform you in our Dispatch Confirmation if an electronic invoice is available. 2. RIGHT OF CANCELLATION UP TO 14 DAYS, EXCEPTIONS TO CANCELLATION AND OUR VOLUNTARY RETURNS GUARANTEE

STATUTORY RIGHT

Unless one of the exceptions listed below applies, you can cancel your order without giving any reason within 14 days from the day on which you or a third party indicated by you (other than the carrier) receives the goods purchased (or last good, lot or piece if it relates to goods or multiple lots or pieces delivered separately).

You must inform us (İvedik Organize Sanayi Bölgesi Arı Sanayi Sitesi No:67 Yenimahalle Ankara adresindeki Baltacıoğlu Mühendislik Makine Ticaret ve Sanayi Limited Şirketi) of your decision to cancel your order. You may submit your request by contacting us, or using this form. Will communicate to you an acknowledgement of receipt by e-mail.

To meet the cancellation deadline, it is sufficient for you to send your communication before the 14 days’ cancellation period has expired and return the item via our return centre.

Shop.baltacioglu.com.tr does not assume the ownership of the returned product until it is received at the return address.

EFFECTS OF CANCELLATION

We will reimburse all payments received from you for the goods purchased and will not reimburse the shipping costs and customs charges, no later than 14 days from the day on which we received the above communication. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Note that you must send back the goods no later than 3 days from the day on which you communicate your cancellation. You will have to bear the direct cost of returning these goods. You may be liable if the value of the goods returned diminishes due to the handling of the goods (except when it was necessary to establish the nature, characteristics and functioning of the goods).

OUR VOLUNTARY RETURNS GUARANTEE

Without prejudice to your statutory rights, Baltacioglu provides you with the following voluntary returns guarantee:

All products from the site shop.baltacioglu.com.tr can be returned within 30 days of receipt of the products to Baltacioglu if the products are complete and are in an unused and undamaged condition.

If you return products according to this voluntary returns guarantee, you will have to cover the customs charges in Turkey when you will return any product(s). 

Likewise the transport risk and return costs are borne by you. This returns guarantee does not affect your statutory rights and therefore does not affect your right of cancellation as described above.

3. PRICING AND AVAILABILITY

All prices are inclusive of VAT.

We list availability information for products sold by us on the website including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by e-mail or by posting a message on the Message Centre of the website as soon as possible if any products you order turn out to be unavailable and you will not be charged for those products.

4. DELIVERY TIMES

Unless otherwise stated on the website, delivery estimates and dates are just estimates. They are not guaranteed delivery times and should not be relied upon as such. Where we provide a guaranteed delivery date and a delivery attempt is not made for the relevant shipment by that date, we will refund any delivery fees associated with that shipment, and otherwise we are not liable to you for late deliveries. Where estimated delivery times apply, you are still entitled have the products sent to you within a reasonable time. If the delay occurs before the products are dispatched, you may cancel your order at any time prior to dispatch.

Your order will be delivered to the transport company within 2-3 business days after receiving your order. We will inform you about the estimated delivery date when we confirm the receipt of your order.

5. PRODUCT INFORMATION

Unless expressly indicated otherwise, Baltacioglu is the manufacturer of the products sold on this website. While we work to ensure that product information on our website is correct, products and any product packaging and materials may be different from that displayed on our website. Please always read labels, warnings and directions provided with the product before use.

In the event of any safety concerns or for any other information about a product, please carefully read the information provided with the product, contact us.

6. CUSTOMS

When ordering products from shop.baltacioglu.com.tr for delivery outside of Turkey you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you, we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from shop.baltacioglu.com.tr for delivery outside of Turkey, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

7. DISCLAIMER AND LIABILITY

Baltacioglu will not be responsible for (i) any loss arising from the unavailability of any product; (ii) losses that were not caused by any breach on our part; (iii) any business loss, loss of sales, profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure; (iv) any indirect or consequential losses; or (v) any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

8. APPLICABLE LAW

The laws of Republic of Turkey govern this Agreement and any dispute of any sort that might arise between the parties. Any dispute relating in any way to this Agreement will only be adjudicated in the courts of Ankara. Each party consents to exclusive jurisdiction and venue in these courts. Notwithstanding the foregoing, either party may seek injunctive relief in any state, federal, or national court of competent jurisdiction for any actual or alleged infringement of such party's, its affiliates' or any third party's intellectual property or other proprietary rights. The United Nations Convention on Contracts for the International Sale of Goods, and any local laws implementing the Convention on Contracts for the International Sale of Goods, do not apply to this Agreement. 9. AMENDMENTS AND SEVERABILITY

We reserve the right to make changes to our website, these Conditions of Sale, our policies, and our listings at any time by posting the changes on our website. You will be subject to the Conditions of Sale and policies available on the site at the time that you order products from us.

If any of these Conditions of Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

10. WAIVER

If you breach these Conditions of Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale.
